Abstract

And the legal systems that organize ownership were developed throughout history. So, possession came to surface. Although it is a realistic case, it has a major role in the legal system and risky functions. It is in the top of reasons of ownership gain because it is the clear and tangible source that enables us to make use of ownership right correctly. In other words, it is the title of manifest ownership. And it is worth mentioning that its importance became more than ownership right because it is an active tool to take advantage of things, right and get benefit from it. This is why, caring about organizing it in law and working on protecting it were described as reasons of boosting stability and security in the society through determining the obvious realistic situations. Since the subject of possession, its transference and its consequences are of special significance due to what Iraq witnessed with regard to big impact of possession transference and its conflict last years, the topic was selected.
